These Terms of Service (the “Terms”) govern your access to and use of Bailey (the “Service”), an early access service operated by the independent creator behind Bailey (“Bailey”, “we”, “us”). Bailey is not yet incorporated as a company; when it is, these Terms will be updated with the company’s details. By creating an account or using the Service, you agree to these Terms.
1. Who can use Bailey
You must be at least 16 years old, or the age of digital consent in your country, to use the Service. If you use Bailey on behalf of an organization, you confirm you are authorized to bind that organization to these Terms, and “you” refers to that organization.
2. Your account
You are responsible for the activity under your account and for keeping your access credentials secure. Sign-in is handled through our authentication provider; you agree to provide accurate information and to keep it up to date. Tell us promptly at hello@trybailey.app if you suspect unauthorized use.
3. What Bailey does
Bailey lets you publish sites and small applications to an address, and gives what you publish a governed data plane: a store to remember values, collect submissions, and count visitors, bounded per project. You can operate the Service by connecting an AI assistant, through the dashboard, or with the command-line tool.
4. Your content
You keep all rights to the files, data and content you publish (“Your Content”). You grant us only the limited licence needed to host, store, process and serve Your Content so we can operate the Service on your behalf. You are responsible for Your Content and for having the rights to publish it.
When your site collects personal data from its visitors, you are the data controller for that data and Bailey acts as your processor. Your obligations are set out in our Privacy Policy.
Because Bailey is in early access, features and limits may change, and the Service may occasionally be unavailable. We’ll do our best to give you reasonable notice of significant changes.
5. Acceptable use
You agree not to use the Service to:
- break the law, or infringe anyone’s rights;
- publish malware, phishing pages, or content that deceives or harms visitors;
- send unlawful, hateful, harassing or sexually exploitative content;
- attempt to breach the isolation between projects, probe, overload or circumvent the Service’s security, rate limits or quotas;
- collect personal data without a lawful basis, purpose and retention, or in breach of applicable data-protection law.
We may suspend or remove content, or an account, that we reasonably believe breaches these Terms, where practical with notice.
6. Plans, billing and free tier
Bailey offers a free tier and, over time, paid plans. Plan limits (number of sites, storage, history, and other quotas) are shown in the app and may change as the Service evolves. Where paid plans apply, prices, taxes and billing terms are those displayed at the time of purchase.
7. Availability and changes
We work to keep the Service available and reliable, but we provide it on an “as is” and “as available” basis. We may add, change or remove features. We may also update these Terms; if a change is material, we will give reasonable notice. Continuing to use the Service after a change means you accept it.
8. Suspension and termination
You may stop using Bailey at any time and delete your content and account.
You can erase what a site has collected (for one person or entirely) from
the dashboard, the CLI (bailey erase), or by asking your
assistant. We may suspend or terminate access for a serious or repeated breach
of these Terms. On termination, the licence in section 4 ends and we will
delete or return Your Content in line with our Privacy Policy and applicable
law.
9. Warranties and liability
To the extent permitted by law, Bailey disclaims implied warranties and is not liable for indirect or consequential damages, or for loss of data or profits. Nothing in these Terms limits liability that cannot be limited by law. Where our liability is capped, it is capped at the amount you paid for the Service in the twelve months before the event giving rise to the claim.
10. Governing law
These Terms are governed by French law, without prejudice to the mandatory consumer-protection rights of your country of residence.
